RECOMMENDATION:
Staff recommends that the City Council:
    1. Reject all bids received on April 1, 2014 for the Section 2 Concrete Repair Project.
    1. Authorize staff to re-advertise the project with a modified project scope.

FISCAL IMPLICATIONS:
Funding in the amount of $365,000.00 was appropriated by City Council through the fiscal year 2013-2014 Capital Improvement Program (CIP) from the Gas Tax Fund ($365,000) for the Section 2 Concrete Repairs Project.  Staff anticipates that even with the modified project scope, a supplemental appropriation will be needed at the time of award.
 
BACKGROUND:
This project is part of the City's ongoing concrete repair and maintenance program.  This annual program removes and replaces damaged or displaced concrete sidewalks, curbs, gutters and drive approaches in the City right-of-way to eliminate trip hazards and to mitigate gutter ponding.  Upgrades such as the installation of curb ramps are also constructed through the program.  Work under the program is performed through a competitively bid contract.
 
Concrete repairs (primarily sidewalks curb, gutters, and concrete drainage swales) are coordinated with established slurry seal maintenance districts.  The goal is to provide a programmed approach to street maintenance in which street repairs, slurry sealing, sidewalk repairs, and traffic markings are completed in the same year on a seven-year cycle.
 
The City is responsible for all concrete improvements within the right-of-way except sidewalks and drive approaches, which are the responsibility of adjacent property owners.  The City's Municipal Code assigns the responsibility for repairing sidewalks and driveways to adjacent property owners (Chapter 7.12.010 -7.12.030).  The competitive bid process ensures residents who must effect repairs to the sidewalks adjoining their properties receive the best possible value.  
 
Upon completion, the Section 2 project will mark the completion of all seven maintenance sections, and future concrete repair expenditures beginning with Section 3 are anticipated to be reduced in scope.
 
Notification of Property Owners  
Staff notified all affected property owners in early April of 2014 of the impending concrete repair project and their responsibility to repair the sidewalk and driveway through a notice describing the program and the competitive bidding process.  As it is currently administered, property owners have the option of hiring their own contractor to complete the repairs through a City right-of-way permit.  
 
Pathway to the Sea
At the February 25, 2014 regular meeting, City Council approved the 2012/2013 Capital Improvement Plan. The Pathway to the Sea project was included as part of the adopted Plan. The City has successfully executed the appropriate agreements with the County of Los Angeles and received all necessary permits to allow construction of project. This long anticipated ADA enhancement will allow all beach visitors an enhanced experience.
 
The Pathway to the Sea project was originally included in this project due to its similarity to the Section 2 repair project.  As part of the re-scoping of the current project, the Pathway to the Sea project will be issued as a separate and standalone project.  Treating the Pathway as a separate project will ensure it will be completed before the summer season begins while staff prioritizes and examines the remaining concrete repairs in Section 2.
 
 
DISCUSSION:
Construction Bid Proposals
This project was advertised for bids in the Beach Reporter, the City's publisher of record and several standard construction industry publications, including the Dodge Green Sheet, Reed Construction Data, and Associated General Contractors of America.  Subsequently, seven sets of plans and specifications were provided to contractors, subcontractors and material suppliers.  A total of eight bids were received and opened on April 1, 2014, as detailed in Attachment 1.
 
CONCLUSION:
Staff recommends City Council reject all bids received for the Section 2 Concrete Repair Project.  Additionally staff requests authorization to separate the Pathway to the Sea portion of the Section 2 project as a standalone project and re-advertise the project with a modified project scope.
